Blue Pharos Customer Service Terms

These Customer Service Terms are between Blue Pharos LLC, with a registered business address of 30 N Gould St, Ste N, Sheridan, WY 82801, United States, doing business as Blue Pharos, and the customer identified during onboarding. The person accepting these terms confirms that they are authorized to act for the customer.
1. Acceptance
Acceptance occurs through versioned clickwrap in the customer workspace. Blue Pharos records the accepting identity, terms version, timestamp, and audit event, and provides a downloadable copy or confirmation.
2. Subscription and payment
The Blue Pharos Marketing Plan costs $300 per month plus applicable taxes. There is no setup fee. The first charge occurs when onboarding begins, and future monthly charges follow the original signup date. The subscription continues until canceled.
Stripe provides checkout, recurring payment, invoices, receipts, payment-method management, and cancellation at the end of the current billing period. Blue Pharos does not store card information. The launch offer does not include promotion codes or ACH payments.
3. Included service
The plan includes:
- the approved preview developed into a verified customer website;
- hosting, maintenance, security, backups, and technical care;
- one standard domain while service remains active;
- initial on-page and local search setup;
- an initial Google Business Profile review when access is available;
- a verified Google Review Growth Kit;
- privacy-conscious analytics;
- one grouped customer-requested update per billing month beginning in month two;
- one customer-approved section-level improvement per paid month beginning in month two;
- three customer-ready text posts per calendar week after launch;
- one monthly recommendation; and
- one monthly visibility report after a complete calendar month of analytics.
The accepted offer presented during onboarding controls the complete current scope and cadence.
4. Launch and revisions
The personalized preview is a concept until the customer enters onboarding and approves the final customer website. One consolidated pre-launch revision is included for supported copy, color, photo, and business-information changes. Corrections to Blue Pharos errors do not consume that revision.
Blue Pharos targets launch within five business days after payment, required information and assets, and final approval are complete. Customer-controlled DNS changes and unresolved third-party verification can extend the timeline.
5. Customer responsibilities and content
The customer must provide accurate information, timely approvals, authorized contact details, required access, lawful content, and usable assets. The customer confirms that it owns submitted material or has permission to use it and that its factual claims are accurate and supportable.
Blue Pharos may reject or remove material that is unlawful, infringing, deceptive, unsafe, unsupported, technically incompatible, or outside the agreed service. Licensing, insurance, certifications, history, awards, prices, guarantees, testimonials, and other trust claims may require evidence.
6. Monthly updates and additional work
Beginning in month two, the customer receives one grouped update to existing website content per billing month. One unused update may roll into the next billing month and then expires, for a maximum of two included updates in one month. A complete request normally ships within three business days after all required information and assets are received.
The separate proactive improvement follows the same one-month rollover and maximum-two rule. Each improvement is evidence-backed, confined to a supported existing section, and requires customer approval.
New pages, redesigns, custom functionality, ecommerce, booking, integrations, advertising, advanced SEO, social publishing, photography, video, and other expanded work are not included. Additional work requires a written quote and customer approval before it begins.
7. Domains, hosting, and third parties
One standard domain registration and renewal is included while service remains active. Premium or additional domains and exceptional third-party costs require separate written approval. Customer-owned domains remain customer-owned.
The service depends on providers including Stripe, Cloudflare, registrars, email services, and analytics services. Blue Pharos is responsible for reasonable configuration, monitoring, and response but cannot control every third-party interruption. The Privacy Notice identifies current launch providers and their supported functions.
8. Cancellation, failed payment, and refunds
The customer may cancel at any time. Cancellation takes effect at the end of the current paid billing period, and service continues through that date. Blue Pharos does not normally provide prorated partial-month refunds. Duplicate or erroneous charges are refunded, and applicable law controls.
New updates and discretionary work pause while an account is past due. The website remains live during a 14-day grace period. If payment remains unresolved after final notice, Blue Pharos may suspend service and take the website offline. Service may be restored after Stripe confirms payment when offboarding has not completed and the domain remains intact.
If Blue Pharos cannot deliver the agreed standard website for reasons within its control, Blue Pharos will refund the onboarding payment. Customer delay, missing information or assets, unsupported claims, customer-controlled DNS, third-party verification, or changed scope do not establish that failure.
9. Ownership, buyout, and transfer
The customer may request transfer of the approved website export and included standard domain without a Blue Pharos transfer fee after six paid months. Before then, retaining them uses this declining buyout schedule:

Transfer is requested, not automatic. It includes one standard domain, a deployable static export of the approved website, customer-supplied or approved content and assets, and reasonable domain setup help. It excludes the internal admin platform, credentials, automation, prompts, and reusable shared-template tooling.
Standard qualifying transfers target completion within ten business days after valid destination details arrive and applicable balances are resolved. Third-party costs remain the customer’s responsibility.
10. Intellectual property license
The customer retains ownership of material it supplies and grants Blue Pharos the rights needed to store, process, edit, display, deploy, and transfer that material to provide the service.
Blue Pharos retains its pre-existing and reusable platform code, templates, automation, methods, prompts, and general know-how. A transferred static site may contain rendered output from that system without transferring the reusable system itself.
11. Privacy, communications, automation, and retention
Blue Pharos may use privacy-conscious analytics and vetted service providers or automation to deliver the service. A provider receives only the information reasonably needed for its supported function. The Privacy Notice identifies current providers and material processing purposes.
Vetted automation and AI providers may process the minimum approved business content needed for a supported workflow. Blue Pharos remains accountable for reviewing final customer work and does not present automation as a substitute for that review. Analytics can be incomplete or interrupted and must not be presented as guaranteed evidence.
Required service communications include access, security, billing, onboarding, approvals, launch status, included content, reports, and support. Unrelated promotional marketing requires separate consent.
Contact-form submissions are delivered to the customer’s verified business email with spam controls and minimal operational retention. Blue Pharos does not provide a CRM under this plan. Operational workspace and uploaded customer data are retained for 90 days after service ends, then deleted or anonymized unless legal, accounting, security, or dispute requirements require longer retention.
12. Availability and support
Blue Pharos targets 99.9% monthly uptime without automatic service credits and targets acknowledgment of normal support requests within one business day. Scheduled maintenance, customer actions, DNS or registrar events, force majeure, and third-party events outside reasonable Blue Pharos control are excluded from the uptime target.
13. No performance guarantee
Blue Pharos does not guarantee rankings, traffic, leads, calls, sales, revenue, platform approval, or particular marketing outcomes. The service provides the agreed deliverables, maintenance, reporting, recommendations, support, and stated operational targets.
14. Warranty, liability, disputes, and legal notices
Except for the express commitments in these terms, the service is provided as available and to the fullest extent permitted by law without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. Blue Pharos does not warrant uninterrupted third-party services or any particular ranking, traffic, lead, call, sale, revenue, or platform outcome. This paragraph does not remove an express service commitment stated elsewhere in these terms.
To the fullest extent permitted by law, Blue Pharos is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data. Blue Pharos’s aggregate liability arising from the service is limited to six months of subscription fees under the plan in effect when the event giving rise to the claim occurred. The limitation does not apply to fraud, willful misconduct, or an obligation that applicable law does not permit the parties to limit.
These terms are governed by Wyoming law, without applying rules that would select another jurisdiction’s law. Before filing a lawsuit, the complaining party must send written notice describing the dispute and allow 30 days for a good-faith informal resolution. If the dispute remains unresolved, proceedings may be brought in the state courts located in Sheridan County, Wyoming, or an applicable federal court in Wyoming. These terms do not require private arbitration and do not prevent either party from using an applicable small-claims process.
Legal notices to Blue Pharos must be sent to legal@bluepharos.com and are effective when delivery is confirmed. Customer notices use the verified email and workspace contact recorded during onboarding.
15. Changes to these terms
The accepted terms version governs the customer relationship until a later version is presented and accepted as required. Blue Pharos retains the accepted version and its audit evidence. A website or repository edit alone never changes an existing customer’s accepted terms.
